1. Agreement to Terms
By accessing or using WebCraft's services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing our services.
2. Services
WebCraft provides website design and development services. Our services include but are not limited to:
- Custom website design and development
- E-commerce website solutions
- Website hosting services
- Search engine optimization (SEO)
- Website maintenance and support
- Content management system (CMS) integration
3. Project Timeline
We commit to delivering your website within 7 business days from the date we receive all required materials and content from you. This timeline is contingent upon:
- Timely provision of all content, images, and materials
- Prompt feedback and approval during revision rounds
- Clear communication of requirements during the discovery phase
Delays in providing materials or feedback may extend the project timeline accordingly.
4. Payment Terms
Payment for our services is structured as follows:
- 50% Upfront: Required before project commencement
- 50% Upon Completion: Due before final delivery and website launch
All payments are non-refundable once work has commenced, except as outlined in our Refund Policy. We accept payments via bank transfer, credit card, and other methods as specified during checkout.
5. Revisions
Each package includes a specified number of revision rounds:
- Starter Package: 1 revision round
- Growth Package: 2 revision rounds
- Pro Package: 3 revision rounds
Additional revisions beyond the included rounds will be billed at our standard hourly rate. Major scope changes or feature additions may require a separate quote.
6. Intellectual Property
Upon full payment, you will own the rights to the final website design and custom code created specifically for your project. However:
- We retain the right to use the project in our portfolio and marketing materials
- Third-party assets (fonts, images, plugins) remain subject to their respective licenses
- Our proprietary frameworks, tools, and methodologies remain our intellectual property
7. Client Responsibilities
As our client, you agree to:
- Provide accurate and complete information during the discovery process
- Supply all required content, images, and materials in a timely manner
- Respond to requests for feedback within 48 business hours
- Ensure you have the rights to use any content you provide
- Make timely payments as per the agreed schedule
8. Hosting and Maintenance
All packages include one year of hosting. After the first year, hosting can be renewed at our standard annual rate. We provide:
- Secure, reliable hosting with 99.9% uptime guarantee
- SSL certificate for secure connections
- Regular backups of your website
- Basic security monitoring
9. Limitation of Liability
WebCraft shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of our services.
Our total liability for any claims under these terms shall not exceed the amount you paid us for the services in question.
10. Termination
Either party may terminate the agreement with written notice. In case of termination:
- Client-initiated termination: Fees for work completed will be due
- WebCraft-initiated termination: We will refund fees for undelivered work
- All intellectual property rights for completed work transfer upon payment
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these terms will be resolved through arbitration or in the courts of competent jurisdiction.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes by posting the new Terms of Service on this page. Your continued use of our services after such modifications constitutes acceptance of the updated terms.
